I think that arresting her was a bit much. She is a teenage girl, of course she is going to be texting, and of course she is going to rebel a little bit. The reasonable course of action in my opinion would be to give her a warning this time, punish her the next time (the teacher's word of a cell phone is enough for at least a detention), and if it happened after that, punish her accordingly. It is a matter that should be resolved entirely by the school. Our school took up giving out fines for students who skipped class or who got caught with cell phones more than twice. Nothing is ever going to stop students from having phones altogether, especially at that age.

I think the repeated attempts at getting her to stop texting was a warning enough. The girl obviously has respect for no one.

she wasnt arrested for the texting, she was arrested for lying to police, teachers, and disobeying the teacher (who has almost all of the same rights that your parents have over you).

Not quite.... Teachers have almost no rights over children, the only authority they have is what the school gives them. When even then is very little, just enough to enforce the rules, and often times not even truly enough for that.

Now, onto the case at hand. A simple suspension would have worked in this situation, as the actual fine was not called for. Honestly, a $290+ fine for texting, which isn't actually that disruptive so long as the phone is on a "silent" setting is a bit extreme. I would be fighting the charges in court if I was the parent.....

Not a $290 fine....it was for bail. If they wanted to leave her in jail, either because they didn't want to pay, or because they wanted to "teach a lesson" they didn't have to pay it. We'll see how things pan out in this case, but I still think she got what she had coming.

I'm torn on this one.
I do believe the teacher should have smack the retard side the head and took the phone and returned it to the parent.
She did need a lesson and since they can't do that and it seems with our great society of not wanted to abuse our children it was the only recourse the teacher/school had
On one hand I'm really getting tired of this BS society we live in where the power the teachers need have been taken away in the majority of states.
The real life and appropriate thing to have done is forcefully take the phone. Drag her down to the office and make her wait for 30 minutes. Then the principle should have called her parents with and then gave the student the option of suspension for the rest of the year or 10 whacks with a large paddle in the gym with the entire school watching.

LOL. It sounds like this student has had other problems so maybe this was the final straw. If this had happened to my kids I may have let the sit a night in jail if there weren't too many scary people in there and up here that's likely to be the case.

actually any school faculty member (yes even the janitor) can search any student at any time if they have "reasonable suspicion" (not even probable cause!!!). The reason that i know this is because we had the school's resident officer come in and talk to us (because we were studying the 4th amendment in American Government class) and it turns out that as long as you are enrolled in school, and present on campus, you have almost no rights, your 1st amendment rights are severely restricted, your 2nd amendment rights are totally gone (who needs a gun at school anyway....), your 4th amendment rights are also TOTALLY GONE because anything you bring on campus is allowed to be searched, this means cars in the student parking lot too. Your right to privacy is gone too, that means that if your phone is taken the school can read through your txts, contacts, calenders, ect...

I actually agree with the fact that you should have these rights taken away during school. The main reason that i think that this is a prudent course of action is because my school has a MAJOR drug problem, in the 1st week of school 19 expulsions and arrests for selling of illegal substances, in the next week 3 cars searched and 18 CASES of beer taken into custody, in the 3rd and 4th weeks 17 kids arrested for hard drugs (Speed, LSD, PCP, Heroin, Crack, ect...). The rest of the year is pretty much a steady stream of 5 - 10 arrests/ suspensions/ expulsions a week....** will try to get documentation from resident officer**

Just curious, but where does this information come from? If it's just the "school's resident officer" coming in to talk with students then that could not be an actual fact. Also, lets keep in mind that these rules change by state, city, and even by school.

The rules may just be because of my school's drug problem.... but i get where you are coming from, and on monday i will ask him if he has any sources where i could get the data from.
